What is the CCPA?

  • The California Consumer Privacy Act is the US equivalent of the GDPR and the first comprehensive data protection law of a US state. The CCPA governs the handling of personal information from customers in California. Unlike the GDPR, the CCPA does not require the user to give prior consent for the data to be processed, but gives the user the right to object to this use by opting out.

  • The website must inform the user what information is collected from them and whether it is passed on or sold to third parties. The CCPA requires a clearly recognizable link that says “Do Not Sell My Personal Information”. For minors under the age of 16, consent must be given actively; for minors under the age of 13, consent must be given by a legal guardian.

  • Data subjects also have the right to receive a list of the data collected and the purposes for which it has been used in the past twelve months. The consumer may also request the deletion of the data. An opt-out must not result in discrimination (e.g. in the form of higher product prices in the shop).

  • Who does the CCPA apply to?

    The California Consumer Privacy Act applies to for-profit businesses that exceed one of three thresholds: The business collects information from more than 50,000 California residents ; it has annual revenues of at least US$25 million; more than 50 percent of its annual revenuescome from the sale of that personal data.

  • What does the CCPA mean for me?

The General Data Protection Regulation (GDPR) applies in the European Economic Area and is translated into concrete data protection laws by the individual member states. The CCPA, on the other hand, prescribes the possibility of rejection (opt-out) .
