Updates on data protection laws around the world you may have missed in 2023
As we begin the new year, we’re offering you a refresher on international law changes you may have missed over the past year. If your company operates globally or even in countries like the US or countries like South Korea or Saudi Arabia, you should stay abreast of the latest data protection updates and ensure your website or application is compliant.
Utah Consumer Privacy Act (UCPA) takes effect in December 2023
The Utah Consumer Privacy Act (UCPA) was passed in 2022 but did not take effect until December 2023. Similar to other privacy laws in the United States, it establishes important laws to protect residents’ personal information. Key Points: The UCPA provides consumers with certain rights regarding their personal information. These rights include access to and deletion of personal data, objection to certain data collection and use practices, and receiving a copy of your data in a usable format.
Oregon Consumer Privacy Act takes effect July 1, 2024
The Oregon Consumer Data Privacy Act (OCDPA), signed in July 2023, will go into effect on July 1, 2024. Some key points: The OCDPA gives consumers the right to access, correct, delete, and obtain a copy of their personal information. In addition, opt-out mechanisms must be consumer-friendly and use a preference signal by January 1, 2026. Data processors must also take measures to ensure that “de-identified” (anonymous) data cannot be linked to individuals.
Update on South Korea’s amended PIPA in September 2023
South Korea’s Personal Information Protection Commission (PIPC) has announced the adoption of amendments to the Personal Information Protection Act (PIPA) in September 2023. The changes include expanded requirements that companies must meet when transferring personal data abroad, as well as the authority of the PIPC to pause overseas transfers if it deems this necessary in certain situations. Another important change is the improved protection of children’s personal data. The data controller must provide for a procedure to verify the legal guardian or representative of a child under 14 years of age. This representative should be able to consent or object to the processing of their personal data on behalf of the child.
Saudi Arabia’s PDPL came into force in September 2023
The Saudi Arabian Personal Data Protection Law (PDPL) came into force on September 14, 2023. This data protection law also highlights the importance of clear consent from data subjects, particularly when processing sensitive data or for direct marketing purposes. The PDPL also requires organizations to carry out a data protection impact assessment in certain situations, such as when using new technologies. An important requirement for some organizations and industries covered by the PDPL is the application of more restrictive measures when processing health and credit data.
