Data Privacy News: New Cookie Guidelines for Switzerland

On February 3rd, the Swiss Federal Data Protection and Information Commissioner (FDPIC) released new guidelines on the processing of data through cookies and similar technologies. Currently available in German, these guidelines mark the first time the FDPIC has published specific cookie-related guidance. Key points include the prohibition of dark patterns and the requirement to provide users with a clear option to withdraw consent or opt out of cookies.

These new requirements stem from the Swiss Federal Act on Data Protection (FADP) and represent a significant step towards the normalization and necessity of using cookie banners and consent management platforms (CMP) for companies operating in Switzerland.
