Legal Update: Belgian Market Court’s decision on IAB Europe’s Role in TCF

On May 14, 2025, the Belgian Market Court overturned the 2022 decision by the Belgian Data Protection Authority (APD) regarding IAB Europe and the Transparency & Consent Framework (TCF) v2.0. The Court confirmed in its ruling that IAB Europe is a joint controller only for the creation and use of TC Strings by publishers and vendors. However, the Court also ruled that IAB Europe is not a joint controller for participants’ broader data processing (e.g., for advertising purposes). This significant decision supports the continued use of the TCF. In short, IAB Europe’s joint controllership ends with the TC String. Looking ahead, IAB Europe must implement the proposed TCF changes that reflect its limited controller role.

GDPR Fine: Aylo Freesites fined €58,400 in Cyprus

The Cypriot Data Protection Authority fined Aylo Freesites €58,400 for multiple GDPR violations. The investigation revealed the unlawful use of cookies and improper processing of visitor data. Key failures included a lack of transparency and accountability, and an absence of a lawful basis for data handling. This serves as a reminder that non-compliance, particularly with regard to cookie consent, can result in substantial penalties.
