Does your business fall under the DSA? Find out with our free guide (PDF)
The Digital Services Act (DSA) introduces new responsibilities for digital services operating within the EU. The Act places a strong emphasis on transparency, user protection and accountability. However, the specific requirements will depend on the type and scale of your business. To help you determine whether your company is subject to the DSA, we have created a clear and practical checklist. By answering a few targeted questions, you will gain a better understanding of what actions, are required to comply. Depending on your business model, this may include GDPR compliance, adherence to the Whistleblower Directive, or implementing a transparency layer if you operate in the online advertising space. As non-compliance can result in fines of up to 6% of annual global turnover, it is important to assess your company’s obligations as soon as possible. Our guide outlines who is affected and what steps are necessary to ensure compliance.

German Court: Google Tag Manager requires consent
In a recent court ruling, the Administrative Court of Hanover confirmed the Lower Saxony State Commissioner’s legal opinion that prior user consent is required before activating tools such as Google Tag Manager (GTM). The case was brought forward by the Lower Saxony State Commissioner for Data Protection, who claimed that a media company in Lower Saxony did not meet the required data privacy standards with its Google Tag Manager setup on its website. The court emphasized that GTM requires consent as websites can function without it, and loading GTM may result in user data, such as IP addresses, being transferred to Google. Nevertheless, many websites still run GTM tags before obtaining consent, which constitutes a violation of data protection law. To ensure that such tags are blocked until valid consent is obtained, a Consent Management Platform (CMP) should be implemented. Companies are urged to take action, as data protection authorities and users alike are becoming increasingly vigilant.
