Microsoft Clarity: Consent Mode Deadline 31 October

From 31 October 2025 onwards, Microsoft will enforce stricter consent signal requirements for page views coming from the European Economic Area (EEA), the United Kingdom and Switzerland. Activating Consent Mode will then become mandatory when using Microsoft Clarity. To avoid data gaps or loss of conversions, website operators must activate Consent Mode and ensure that the correct consent signals are transmitted to Clarity. Microsoft Clarity now supports Google Consent Mode in addition to its own Consent Mode to make things easier for websites. Websites that have activated Google Consent Mode can now use it for Microsoft Clarity too.

Consent or pay: Granular consent required

Austria’s Federal Administrative Court has ruled that the ‘consent or pay’ advertising model, which forces users to either accept tracking or pay for access to content, is not compliant with the GDPR. This decision follows a case brought against Der Standard, a major Austrian newspaper, in August 2025. The newspaper’s ‘Pay or OK’ model required users of its website, derstandard.at, to either consent to extensive tracking or pay €9.90 per month for an ad-free experience. The court found that this “all-or-nothing” approach failed to meet GDPR standards. Instead, users must be offered a genuine choice, including the ability to specify which types of data processing they consent to. This ruling reinforces the need for websites and apps to implement granular consent options, enabling individuals to accept or reject specific purposes individually.

EU–US Data Privacy Framework: EU court approves continued US data transfers

On 3 September 2025, the EU General Court upheld the validity of the EU–US Data Privacy Framework, enabling businesses to continue transferring personal data to the United States via this mechanism. The Court confirmed that US law offers essentially equivalent protection to that provided by the GDPR. Website owners using US-based services, such as analytics or marketing tools, may continue to transfer personal data to the United States under the current framework.
