On April 4, 2023, together with the Bundesverband IT-Mittelstand eV (bitmi), the webinar on the topic Use cookie banners in compliance with the GDPR took place.

Overview

In this webinar we will discuss the basic legal requirements for a GDPR compliant cookie banner, presented by a data protection expert with many years of industry experience. When it comes to compliance, there is no middle ground: either your banner is compliant or it isn’t. Because of this, website owners should understand the basic (but often overlooked) requirements of the law. Because others may have different interpretations of compliance, we’d like to use this webinar to provide some clarity.

What happens in case of non-compliance?
In the worst case, fines. From a few hundred euros to several million. Examples are Carrefour, Amazon, Meta and Google. In all cases, the fines are about what you want the cookie banner to look like.

All providers claim that their tool is legally compliant, which unfortunately is not always the case. It is therefore important that you, as the website operator, control what should appear in your cookie banner and which functions must be activated. As a little help, there is a checklist at the end of the video to ensure you meet the basic requirements. Topics from content to graphic design are addressed and the different levels of a cookie banner are explained. Since the first level (Welcome Level) is the most visible, it is important that consent is obtained in a legally compliant manner, as explained in more detail in the video. At the second and third levels, users can update their preferences in more detail, and here too there are requirements that users need to be aware of.
