International data protection law – important updates
Not only in Germany does data protection play a major role, there are also constant innovations and adjustments to data protection laws in the international environment. In this context, we ensure that we are up to date with all current changes and new laws that come into force. As always, you can assume that the consentmanager solution is up to date and complies with current data protection laws. Below is a summary of the most important recent data protection news:
US states are enforcing new privacy laws: Colorado Privacy Act & Connecticut Data Privacy Act CTDPA
The long-awaited Colorado Privacy Act has reached an important milestone. The state privacy law was finalized and went into effect on July 1, 2023. The new law gives citizens the right to opt out of targeted advertising, the sale of their personal information and certain types of profiling. In particular, the requirement for websites to introduce the Universal Opt-Out Mechanism, which requires websites to provide their users with a single opt-out button for all marketing or analytics services from which the user can unsubscribe .
Connecticut is also making great strides in protecting consumer privacy with the introduction of the Data Privacy Act. The Connecticut Data Privacy Act, effective July 1, 2023, ensures that companies doing business in that state disclose the types of personal information they process, limit the collection of personal information to the reasonable, relevant and necessary, obtain consent before processing a consumer’s sensitive data and respond to requests to exercise consumer rights under the CTDPA.

EU Commission adopts adequacy decision on EU-US data protection framework (DPF).
The European Commission announced on July 10 that it had adopted an adequacy decision on the EU-US data protection framework. This means that the US will in future offer an adequate level of protection for data transfers of personal data between the US and the EU. The prerequisite for this, however, is that US companies have themselves certified accordingly.

consentmanager is now also a registered consent management platform in the IAB Transparency and Consent Framework (TCF) in Canada. The IAB Canada addresses the Canadian legal landscape and provides a framework for obtaining and managing user consent for digital advertising activities. Through this collaboration, consentmanager can continue to help companies meet the demands of today’s online environment, as the IAB is the leading compliance Standard for publishers, technology providers, agencies, advertisers and digital marketers.
Revision of the Swiss Data Protection Act will come into force in September 2023
The revision of the Swiss data protection law, which will come into force in September 2023, represents an important update of Swiss data protection law. In total, there are eight major changes for companies, including the obligation to keep a register of processing activities, which is now mandatory, and the fact that only the data of natural persons and no longer those of legal persons are affected. However, the Swiss Federal Council points out that companies that already comply with the EU General Data Protection Regulation (GDPR) only need to make minimal adjustments.

More optimizations and adjustments in July
With the July update, it is now possible for existing customers to purchase so-called add-on products. In addition, the function was created to insert further user-defined links in the footer of the cookie banner. In addition, some errors have been fixed, such as the absence of the “All languages” function in the custom categories of processed data and in the additional legal bases in the new design. The error when creating new providers has also been corrected.
