How can I sign a data processing agreement with you?

In short: You do not need to sign a separate data processing agreement. It is already part of our Terms and Conditions and takes effect when you sign up.

The data processing agreement (also known as DPA, AVV, Auftragsdatenverarbeitungsvertrag, or DPV) is included in our Terms and Conditions as Annex 1: Data processing contract. By creating an account with consentmanager you have already accepted it, so there is nothing extra to sign, print, or send back.

What the agreement covers

The agreement is concluded to meet the requirements that Article 28 of the GDPR places on processing carried out on your behalf. It sets out:

  • The type of personal data processed and the groups of data subjects concerned, described in Appendices 1.1 and 1.2
  • Your right of instruction as the controller
  • The technical and organizational measures consentmanager applies under Article 32 of the GDPR, listed in Appendix 1.3
  • When and how consentmanager informs you, including the information a personal data breach notification must contain
  • Your control and audit rights
  • The use of subcontractors, listed in Appendix 1.5
  • How inquiries and the rights of data subjects are handled
  • Liability between you and consentmanager
  • What happens to the data when the main contract ends
