IAB TCF v2.3: Key updates and action steps 

IAB Europe has released TCF v2.3. The main change from v2.2 is a mandatory “Disclosed Vendors” section in the TC string, designed to make it clearer whether a vendor was actually shown to a user. consentmanager clients can already activate TCF v2.3 in the CMP dashboard. EDPB’s enforcement focus for 2026: Transparency obligations in the spotlight

The EDPB has confirmed that its coordinated enforcement action in 2026 will focus on GDPR transparency obligations (Articles 12–14). In practice, this means regulators across Europe will take a close look at how clearly publishers, websites and platforms explain what data is collected, how tracking works, and how advertising and partner data sharing are presented to users. Now is a good time to review your privacy policy and cookie banner/CMP layer to ensure the language is clear, purposes and vendor descriptions are consistent.

CJEU ruling: Newsletters can count as direct marketing in certain cases

A recent CJEU ruling (Inteligo Media, C-654/23) clarifies that a newsletter can qualify as direct marketing under the ePrivacy Directive even if it appears “informational,” especially where it effectively promotes paid content. That means the ePrivacy email rules apply: you’ll generally need prior opt-in consent (unless the soft opt-in exception applies), and you must always provide a clear, free unsubscribe option at sign-up and in every email.
